Is someone else sharing their server with you, or is it your own? Either way you don’t need a VPN unless you are streaming from app like Cinema HD. If you are using a Debrid service, like real-debrid, a VPN is optional.

Even if they could, they don’t care. They aren’t out to get their customers legally punished. That would be bad for business.
Do you know if Plex or emby are keeping track of what’s being watched?
The only track is within the server’s database from the person sharing with you, so that you can resume viewings between your devices and know what you already watched.
