No. Warp is made by Cloudflare. They’re the same thing. Warp is a product of Cloudflare. And Cloudflare is absolutely not okay with piracy. You can certainly do it if you so choose, but if they do get a DMCA notice, they’re not going to be too happy that. Their CEO is a lawyer who does cyber law, if that says anything. There is no way around that. If you get caught, you’ll be screwed. So I don’t recommend it. There are far better areas on reddit to get those kind of answers. I know that’s kindof a thing on r/selfhosted so you may wanna ask there (where it’s not an offical reddit)

And hardcore Cloudflare bros, like myself, who use their free program extensively do take offense to these sort of inappropriate questions. Yes. And the 1.1.1.1 service exists for that reason and that was a big reason for putting out there.
But Cloudflare has always been very specific about piracy and it’s in the TOS several times. Because it degrades the network and clogs the caching with garbage. If you’re a hardcore Cloudflare bro (which you should also know is a safe designation because running around posing as a Cloudflare employee is very forbidden. They get special badges for that and you don’t have one. So you’re a Cloudflare bro) then you know they are total anarchists…until they say you can’t be. The TOS is written very easily and clearly to lay out those rules and there isn’t too much they don’t allow. But piracy is one of the things they don’t. And unless a Cloudflare employee says otherwise, I’m not going to help a pirate. I like the free program.
And to answer your second question DMCA notices get forwarded to the ISP by the legal team to make sure that person is off their network as per the TOS.
to clarify - I interpreted cloudflare bro as an avid fan, I’m in no way associated with cf, I’ve used their services since they launched.
TOS are also ways for providers to claim no responsibility - hence at the bottom of every pirate site is a declaration that they do host any of the content.
I think for this discussion to be productive that cloudflare should comment on how they handle the privacy of warp (if at all) because all of the material I find is surprisingly vague unlike the old days where privacy was the focus.
There is a special area on the Cloudflare site that has the TOS broken by service, including 1.1.1.1 as well as the general TOS. You can find the information there. I am not going to bug a busy Cloudflare employee to get clarification over something that should be pretty obvious.
